CONSIDERING
that:
the above mentioned
Institutions want to co-operate in order to improve their
activities in the field of agricultural and forestry engineering
through common projects and activities;
the above mentioned
Institutions carry out voluntary or compulsory testing in
the field of agricultural and forestry engineering assessing
performances and/or safety, and/or environmental protection,
and/or animal welfare requirements in animal husbandry and/or
other aspects;
the above mentioned
Institutions carry out activities in order to inform operators
on the best use of equipment in the field of agricultural
and forestry engineering through extensions services, publications
and other activities;
the above mentioned
Institutions carry out research and development projects
in the field of agricultural and forestry engineering;
and that
the above mentioned
Institutions wish to strengthen the cooperation
among themselves with the aim to develop and optimise efforts
in order to reach high level results;

AGREE THAT:
Art.
1
(Participants)
This Agreement
concerns the testing stations belonging to the following Institutions:

Other participants may be joined under the approval of all
the above mentioned Members.
Art.
2
(Aims)
The Institutions
in art. 1 are joined in the ENTAM - European Network for Testing
Agricultural Machines and act as ENTAM Members for at least
one of the following aim:
develop common
activities in the field of agricultural and forestry engineering;
develop common
activities and documents with the aim to develop testing
activities for the mutual recognition of test and test reports
in the field of agricultural and forestry engineering;
develop common
research projects;
promote the
exchange of information among the Institutions;
keep contacts
with other National, International, public and private Institutions.
Art.3
(ENTAM
membership)
1. Ordinary
Members
ENTAM Members can
be involved in the network activities based on a 3-level membership.
All levels have the right to vote during the Annual Meeting
and a higher level includes also the activities stated in
the lower levels:
The "Associated"
membership implies the possible recognition of test reports
made by other Members and the participation at the Annual
Meetings as well as other activities, except those stated for full or premium members.
The "Full"
membership gives the Member the possibility to carry out
tests that can be recognized by other Members or become
an ENTAM recognized test.
The "Premium"
membership implies an unlimited involvement in the activities
of the ENTAM with an active participation to international
projects and the access to the funds raised through these
extra activities.
A Member can change
level of membership. The request of change as well as new applications have to be expressed
and published at the Annual Meeting. No change from a higher
to a lower level can be made by a Member if he is participating
in an activity which is referred to the higher level.
2. Observer
Members
New applications
for the ENTAM membership will be presented during the Annual
Meeting and should be approved by all Members. The new Members
are accepted as "Observer" Members.
The "Observer" Members who want to reach the level of "full"
or "premium" membership listed in point 1 must prove their
ability of conducting tests on the ENTAM quality level, the
final decision is taken during the following annual meeting.
3. Honorary
Members
The "Honorary"
membership is appointed to International Organisations.
Art.
4
(Test
recognition)
To reach the
aim of a common testing activity and a mutual recognition
of the tests the Institutions listed in art. 1 work on the
basis of ENTAM common testing procedures or methodologies
("ENTAM common methodology"). Every testing procedure must
be based on official international standards (ISO, EN),
and common testing procedures agreed by all Institutions
working in the related Technical Working Group or Team of
Competence. Aim of this activity is to carry out tests which
are summarized in an ENTAM Test Report that can be mutually
recognized by the ENTAM Members.
"Technical Working
Groups" (TWG) are in charge of developing the ENTAM common
methodology, the establishment of a technical working group
is approved during the annual meeting.
"Team of Competences"
(ToC) are responsible for the ENTAM recognition of the test
reports, the institution of a team of competence is approved
during the annual meeting.
The test recognition
procedure and validity is defined in the Annex with the
final aim to reach a common test recognition system for
ENTAM tests.
Art.
5
(ENTAM
organization)
The ENTAM Members
listed in art. 3.1 elect a Chairman who acts and represents
the ENTAM at international level, summons the annual meeting,
fosters the cooperation among the Members for the achievements
of the goals listed in art. 2.
The chairman
election will take place during the Annual Meeting with
the procedure of majority. The Chairman is elected for a
period of 2 years and can be elected for one or more mandates.
An annual membership
fee has to be paid for the functioning of the Agreement
and the amount will be defined in every Annual Meeting.
During the Annual
Meeting a Board of Auditors is elected. The Board is made
of two ENTAM Members representatives and is in charge of
the review of all the financial aspects related to the ENTAM
Network. The Board of Auditors will report to the ENTAM
Members during the Annual Meeting for the approval of the
ENTAM annual balance.
In order to
perform the aims stated in art.2 during the Annual Meeting
Technical Working Groups and/or Teams of Competences can
be settled.
Art.
6
(Meetings)
All the ENTAM
Members are invited to meet themselves at least once a year.
The Annual Meeting is summoned by the Chairman and is organized
by one of the ENTAM Members. The Chairman can postpone the
Annual Meeting with motivated reason.
During the Annual
Meeting the balance and activities of the previous year
should be approved as well as the budget for the new year.
The membership fee for the coming year is proposed by the
Chairman and approved during the annual meeting.
All the decisions
taken during the Annual Meeting must be approved by the
majority of the Members listed in art. 1. Only the application
of new Members should be approved unanimously.
The operating
costs of the Meetings are supported by every Institution
for its own representatives.
The meetings
related to the activity of the technical working groups
or to the Team of Competence are summoned by the leader
of the Technical Working Group/Team of Competence.
Art.7
(Expiration)
This Agreement
will last for five years and is naturally renewed at every
expiration for the same period. It can be modified by the
unanimous vote of the participating Members at the annual
meeting.
All Members
signing this Agreement can withdraw from it through a request
presented during the annual meeting.
Art.8
An Annex regulating
the practical activities is part of this Agreement and can
be modified by the majority of the ENTAM Members listed in
Art. 1.
ANNEX
TO THE AGREEMENT OF THE ENTAM - European Network for Testing
Agricultural Machines
A
- General Agreements
1
In order to support the mutual recognition of the test carried
out by the testing station of the ENTAM Members, the results
of the tests have to be summarized in a test report in English
language.
2 Each
signer of the Agreement listed in art. 3.1 must define the
typologies of agricultural machines that can be tested by
its own testing station in order to make the work of the ENTAM
easier. These competences will be published on the ENTAM website
( www.entam.net) so that
the applicant for a test, farmers and everyone else will know
the skills and competences of the Members of the Network.

The ENTAM website is set up in order to show the activities
of the ENTAM, to publish all the Test Reports and to spread
the name and the goals of ENTAM. In this Website a restricted
area (password-protected) is installed in order to publish
all confidential documents accessible only to the Members.
B
- ENTAM Testing
The ENTAM testing
procedure of a machine/equipment is the following:

The applicant asks an ENTAM Full or Premium Member to test
a machine or equipment for the purposes considered in the
agreement.

The test is carried out by the ENTAM Member who may contract
with other institutions under its own coordination and responsibility.
The tests are carried out according to ISO, EN standards or,
if available, to an ENTAM common methodology. When there is
not an international test methodology the test can be carried
out according a National Standard or Protocol adopted by the
ENTAM Member. The ENTAM common methodology consists of technical
instructions which are discussed, approved and updated unanimously
by a specific Technical Working Group (hereinafter "TWG")
held by the ENTAM Members. The ENTAM TWG is made up of the
experts in a particular type of machine or equipment designated
by the ENTAM Members and its aim is to define the ENTAM common
methodology for testing that kind of machine or equipment
according to the international standards and/or common agreements
assuring a uniform testing by the different testing stations
within the ENTAM.

At the end of the testing activities, a test report containing
the results is issued by the ENTAM Member. If another ENTAM
Member has been involved in the test, the report is endowed
with its mark too. In any case the responsibility of the test
report and the quality of the results are of the performing
Member. The Test Report in English language should be sent
to the ENTAM Office that will inform all the Members and put
it on the ENTAM website as a "ENTAM Registered"
Test Report.
4 All
the Test Reports produced by the ENTAM Members shall be sent,
with their English translation, to the ENTAM Office once a
month in order to publish them on the ENTAM Website and recorded
in the ENTAM database with the "ENTAM registered" Mark.

On every Test Report the last page should contain the "ENTAM"
Logo and the following sentence: "The present Test Report
is made under the performing Institution responsibility and
is registered at ENTAM (European Network for Testing Agricultural
Machines) as the performing Institution is a Member of this
Network. ENTAM has the aim of establishing tests carried out
on performance, safety and environmental aspects of agricultural
and forestry machinery and implements. Please find more information
about the network at www.entam.net
or send an email to info@entam.com."

- ENTAM Recognition of the Test
The ENTAM aim is
to settle a test recognition process based on the ENTAM Common
Methodologies (as defined in point B.2) and
on the assessment of the ENTAM Team of Competence (ToC). The
ToC is made of a restricted group of experts chosen among
those of the corresponding ENTAM TWG and is in charge of the
ENTAM recognition of the test assuring the correspondence
of the technical paper data to the related ENTAM common methodology.
When an applicant
asks for the ENTAM recognition of a test carried out in compliance
to paragraph B, the following procedure has
to be followed:
C.1: the
test was carried out according an ENTAM Common Methodology
and is evaluated by a Team of Competence (ToC):

the applicant must ask the ENTAM Member who performed the
test to start the ENTAM recognition process.

The ENTAM Member starts the recognition process sending by
e-mail to the ENTAM office the request of recognition with
the recognition files in English language. The ENTAM office
forwards the request of recognition with the recognition files
to the ToC coordinator and the ToC Members; the other ENTAM
Members receive the mail in cc for information.

Each ToC member evaluates the test recognition request and
issues the recognition giving his recognition number to the
test and sending it by e-mail within 3 weeks to the ENTAM
office (putting in cc the ToC coordinator).

If all ToC Members have given their recognition numbers, the
ToC coordinator declares to the ENTAM office that the test
is officially "ENTAM recognized".

After that the ToC Members have officially recognized the
test, all the other ENTAM Members are informed and must send
by mail to the ENTAM Office their recognition numbers within
3 weeks.

The recognized ENTAM test report is uploaded in the ENTAM
data base and published with the "ENTAM recognized" logo and
all the ENTAM Members recognition numbers according to a common
layout approved by the ToC. The technical paper, which contains
all the measurements and the evaluation made according the
ENTAM common methodology, remains strictly confidential and
is not published.

If a ToC member do not agree to the recognition of a test,
then he must send his refusal, together with an explanatory
statement for the reasons to the ToC coordinator and the ENTAM
office, within 3 weeks. A refusal is possible only for objective
reasons. The ToC Coordinator informs all ToC Members about
the refusal and the reasons for it and moderate the following
discussion. After the discusson, the ToC Members have to vote
if they will follow the refusal or renew their endorsment
for the recognition of test. The decision has to be taken
with a majority of at least 66 % to give the test the official
status as "ENTAM recognized".

On every Test Report as well as Technical paper the last page
should contain the "ENTAM" Logo and the following sentence:
"The present Test Report is made under the performing
Institution responsibility. The performing Institution is
a Member of the ENTAM (European Network for Testing Agricultural
Machines). ENTAM has the aim of establishing and recognizing
tests carried out on performance, safety and environmental
aspects of agricultural and forestry machinery and implements
according to ISO, EN standards and to the related ENTAM common
methodology.
On the basis
of the ENTAM agreement this test report has been recognized
by the ENTAM Members (ENTAM recognition n. .../........) with
the following recognition numbers.
The detailed text
of this section can be modified by the competent TWG with
an equivalent content under the approval of the Chairman.
9 A Member not giving a recognition number or not participating in the recognition process declares that he is not competent or not in charge in the field of that test report.
C.2: the
test is evaluated by a Team of Competence (ToC) but was carried
out without an ENTAM Common Methodology.

The procedure is the same described in points from 1 to 5
of the above section; the methodology used for the test must always be provided to the ToC Members in English language.

The refusal by a Member of the recognition number is possible
only for objective reasons, which have to be explained and
sent by e-mail to the ENTAM Office and to all the Members.

C.3
The test report is only valid for machines or equipment that
conforms to the tested machine or equipment. The validity
of the results are further more restricted to the current
ISO or EN testing standard or the ENTAM common methodology
used during the test.
D
- ENTAM Office
An ENTAM Office
is set up in Rome and will be held by ENAMA for a duration
according to the decisions of the Members.

The ENTAM Office will have the following aims and dues:
a. to support
the Chairman and the Board of Auditors with respectively two
and one meetings every year;
b. to co-ordinate
the work of the Teams of Competence and the Technical Working
Groups with a maximum of ten meetings every year;
c. to maintain
the web site and test database and keep all testing methodologies
in the restricted area of the ENTAM web site;
d. to develop
contacts with the European Union in order to promote ENTAM
activities and propose international project with two meetings
per year in Bruxelles with EU officers in order to present
project proposals coming from the Members and checking their
feasibility;
e. to maintain
contacts with other Institutions by correspondence and meetings
if necessary;
f. to collect
and spread all useful information;
g. to provide
all common correspondence;
h. to organise
the Annual Meetings together with the testing station where
they will be held;
i. to bear
the costs of the Chairman related to the ENTAM activities;

The ENTAM Office is supported with a contribution of all Members
taking part in the Agreement. The amount will be decided during
the Meetings. A sponsoring from Members or private or public
companies with the exception of Agricultural and Forestry
Machinery Manufacturers is possible.
E
- ENTAM international activities: Technical Working Groups,
Team of Competence, research projects
1 Technical
Working Groups (TWG) are in charge of developing the ENTAM
common methodologies. New TWG can be built among the Members
for every Machine Typology but must be approved unanimously
during the annual meeting by the ENTAM Members. Every TWG
has a leader elected among the TWG Members with the majority
of participants and will be in charge for 4 years with the
possibility to be elected for other periods. The acceptance
of a new Member in a existing TWG is voted by the TWG Members
The activities are coordinated by the TWG Leader in accordance
with the ENTAM Office. The Reports of the TWG(s) are published
in the Annual Report and on the ENTAM Website by the ENTAM
Office after being approved unanimously by the TWG

The Team of Competence (ToC) is made of a restricted group
of experts chosen among those of the corresponding TWG and
is in charge of the ENTAM recognition of the test assuring
the correspondence of the test report and the technical paper
data to the related ENTAM common methodologies, EN and ISO
standards. The settlement as well as the approval and the
confirmation of a ToC is approved unanimously during the annual
meeting by the Members. Every ToC has a leader elected among
the Members of the ToC with the majority of participants and
is in charge for 2 years with the possibility of other mandates.
The acceptance of a new Member in a existing Team of Competence
must be voted unanimously by the ToC Members. The activities
are coordinated by the ToC in accordance with the ENTAM Office.
3 ENTAM
common methodologies, research and development projects carried
out and all other activities listed at the art. 2 of the Agreement
should remain confidential. Special versions of ENTAM common
methodologies (only requirements, no special direction for
measurement), can be published on the ENTAM homepage if they
are released by the corresponding TWG.
F
- Other aspects
1 After
two years of missing payment Members cannot participate at
the common activities and will not take part in the work carried
out by the Technical Working Group or the Teams of Competence.

Organisations of other countries even non European may join
ENTAM.

FAO is an Honorary Member of ENTAM with the purpose to use
the results of tests carried out by the ENTAM Full Members.

Honorary and Observer Member(s) are not paying the annual
fee and may promote the ENTAM activities with the authorisation
of the ENTAM Office.

Approval of Documents: ENTAM annual activity report and Financial
Report are approved during the ENTAM annual meetings. All
other Documents like Meeting Reports, Reports of the Technical
Working Groups might be approved online by sending an e-mail
to the ENTAM Office. If no comments will arrive to the ENTAM
Office, the document will be considered as approved after
30 days from the sending date. The Annual Activity Report
and the Annual Financial Report must be presented by the ENTAM
Office during the Annual Meeting.

The Members will meet once a year in the location and date
chosen by the Members during the annual meeting according
to the availability of the Hosting Member where the Meeting
will be held and will discuss the annual draft report (from
January up to December) that will include a summary of the
activities, the financial budget and the proposal for new
activities. At least one month before the Annual Meeting a
draft Agenda will be sent to the Members by the ENTAM Office.

The report of the meeting containing the annual report will
be sent to the Members in the next 30 days following the end
of the Annual Meeting and will be considered accepted if no
comments have been made in the following 30 days.
